XPLORNET CONTEST
RULES AND REGULATIONS
- Ways to Enter the Contest.
No purchase is necessary to enter. The Xplornet contest (“Contest”) commences 12:00AM EST on August 17, 2020 and ends 11:59PM EST on September 13, 2020 (the “Contest Period”). To enter the Contest, visit the Contest website at mix967.ca/contests/2020/07/xplornet-contest/ during the Contest Period and follow the on-screen instructions to complete and submit the online entry form. All entries that are incomplete, illegible, damaged, irregular, have been submitted through illicit means including use of any automated system to participate, or do not conform to or satisfy any condition of these Contest rules and regulations may be disqualified. All entry forms submitted become the property of the Sponsors and will not be returned. Limit of one entry per person permitted during the Contest Period.
- Eligibility
The Contest is open to legal residents of Ontario who are 18 years of age or older at the time of entry. Employees, officers, and directors (including immediate family members and members of the same household) of Xplornet Communications Inc. and Blackburn Radio Inc. (the “Sponsors”) and their respective affiliates, distributors, dealers, marketing representatives, printers, advertising or promotional agencies, or any other organization associated with the Contest are not eligible to participate.
- Prize
One grand prize is to be awarded consisting of $150 Gift Certificate to Colasanti’s Tropical Gardens. Gift Certificate is subject to terms and conditions of the issuer. The Sponsors reserve the right to substitute any Prize in whole or in part for a prize of equal or greater value in the event that any component of a Prize is unavailable for any reason. Prize must be accepted as awarded and no substitutions, except as identified above, will be made. Prize may not be sold, transferred or assigned and not convertible to cash. Limitations may apply.
- The Draw
The winner of the Contest will be selected in a random draw conducted by Blackburn Radio Inc. of all eligible entries received during the Contest Period. The odds of winning depend on the number of eligible entries received during the Contest Period. The random drawing will take place at 9:00AM EST on September 14, 2020. The Sponsors will attempt to notify the selected entrant by telephone within 7 days of the draw. In order to be declared a winner, the selected entrant must unaided correctly answer a time-limited skill-testing question and, within 10 days, complete and return to Blackburn Radio Inc. a contest eligibility and liability/publicity release confirming compliance with these rules and regulations, releasing the Sponsors and their respective directors, shareholders, officers and agents from all liability and, except where prohibited by law, permitting the Sponsors to use the selected entrant’s name, address (city and province) and image, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet, in any publicity carried out by the Sponsors. Selected entrant must also provide proof of identity (photocopy of Driver’s License, Passport or any other government-issued photo identification). In the event that the selected entrant is not eligible for any reason, has not correctly answered the skill-testing question or cannot be contacted after two business days of the first attempt to contact the selected entrant, such entrant shall be disqualified and the Sponsors shall have the right to select another entrant and the Sponsors shall be released and discharged from any liability or responsibility in this regard. No correspondence will be made except with the selected entrant.
- General
By entering the Contest, entrants agree to abide by these rules and regulations, and further agree that the decisions of the Sponsors are final. The Sponsors reserve the right at any time without prior notice to suspend, modify or terminate the Contest for any reason. The Sponsors reserve the right in their sole discretion to disqualify any individual they find to be tampering or disrupting the online entry process or the operation of the Contest or acting in violation of these rules. The Sponsors do not assume any responsibility for any lost, delayed, incorrect or incomplete entry information howsoever caused. The Sponsors are not liable for injuries, death, damages or losses of any kind resulting from participation in the Contest or acceptance or use of the Prize. In the event of a dispute, entries submitted online will be deemed to have been made by the authorized account holder of the e-mail address submitted at time of entry. “Authorized account holder” means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted email address.
- Privacy and Personal Information
Personal information collected from entrants will be used by the Sponsors for the purposes of administering the Contest, and, if consent is given at the time of entry, to provide the entrants with marketing information relating to new and existing products and upcoming promotions by mail or e-mail. Entrants are able to opt-in with respect to receiving such marketing information online from Xplornet Communications Inc. The Sponsors will not sell, share or otherwise disclose personal information of the entrants with third parties, other than to third parties engaged by them to fulfill the above purposes or as permitted or required by law. By entering the Contest, entrants consent to the manner of collection, use and disclosure of personal information as set out in Blackburn Radio Inc.’s privacy policy available at https://mix967.ca/privacy-policy and Xplornet Communications Inc.’s privacy policy available at www.xplornet.com/policies/privacy-policy . Any inquiry concerning the personal information held by the Sponsors should be addressed to Blackburn Radio Inc. at imedia.windsor@blackburnradio.com.
- Publicity of Contest Winner
The name of the Prize winner may be posted online or otherwise beginning on the first business day after the winner has been contacted and has returned a fully completed contest eligibility and liability/publicity release to the Sponsor as set out above. By entering the Contest, each entrant consents to the use of his or her name, image, likeness and photographs, without compensation, in any publicity worldwide that is carried out in any media by or on behalf of the Sponsor.
- Subject to Applicable Laws
This Contest is governed by the laws of Canada, is subject to all applicable federal, provincial and municipal laws and regulations and is void where prohibited.
